This case originated with a pro se complaint filed by eleven applicants for Boston public housing and one city councilor. The plaintiff's challenged the June 18, 1988 "Voluntary Compliance Agreement" entered into by the Department of Housing and Urban Development and the Boston Housing Authority. The complaint alleged that the VCA embodies segregative policies which both compact minorities into BHA public housing and delay access by non-minorities into housing developments of their choice. Prior to the preliminatry injunction hearing, City Councilor James M. Kelly withdrew as a plaintiff. The Court found that the VCA agreement was the product of defendants' exhaustive investigative, administrative and enforcement efforts. As such, it is entitled to judicial deference. The defendants' motions to dismiss were granted and the case was dismissed.
